The definition of trademark is any word, name or symbol that is used by a manufacturer or merchant to identify their goods as distinguished from those made or sold by others. Trademarks are of interest to inventors because they offer additional rights to those provided by patents.
They are sometimes confused with other types of identifying marks that have their own unique definitions. Trade Marks are applicable for any sign including any letter, word name, signature, numeral, device, brand, heading, label, ticket, shape, color and packaging. E.g. Adidas, Singapore Airlines
Requirements for Trade Mark
Any sign capable of being represented graphically and capable of distinguishing goods and services.
Registration
- Trademarks that are not registered may be protected under the common law action of "passing off".
- Registration fees are S$306 per trademark for one class of goods.
- Professional fees are charged by the company filing the trademark. Professional fees range from S$500 to S$800 per trade mark for one class of goods.
- The estimated processing time is 4-6 months depending on many factors.(for eg whether anyone challenges the trademark).
